1. Acceptance of Terms

By accessing and using KITEAI services, creating an account, or purchasing a subscription for an incarcerated individual, you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use our service.

2. Description of Service

KITEAI provides AI-powered messaging services exclusively for incarcerated individuals, including:

  • AI-generated responses to research and information requests
  • Social media monitoring through our FOLLOW feature
  • Automated recurring updates via our TASK system
  • Image generation and processing (up to 5 images per eMessage)
  • Creative writing assistance (letters, poems, stories)
  • Educational content and career preparation resources
  • Integration with SECURUS eMessaging system

3. Account Types and Registration

Customer Accounts (Family/Friends)

To purchase and manage subscriptions, you must:

  • Be 18 years or older
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

Incarcerated User Access

Incarcerated individuals access KITEAI through:

  • SECURUS eMessaging system only
  • Assigned KITEAI Service Representative contacts
  • No direct account creation required

4. Acceptable Use Policy

Users agree not to use KITEAI to:

Prohibited Content

  • Request illegal information or activities
  • Circumvent facility security policies
  • Harass, threaten, or harm others
  • Generate inappropriate content
  • Violate correctional facility rules

System Integrity

  • Attempt unauthorized access
  • Interfere with service operation
  • Share account credentials
  • Manipulate subscription systems
  • Abuse AI request limits
Compliance: All content must comply with SECURUS and correctional facility policies. SECURUS or the correctional facility may reject KITEAI eMessage requests or responses that violate these policies. KITEAI is not held responsible for denied eMessages due to content violations.

5. Subscription and Billing

Pricing

  • $25/month for unlimited AI requests per incarcerated individual
  • Standard SECURUS stamp rates apply separately for responses and images sent
  • All features included - no hidden fees

Billing Terms

  • Subscriptions automatically renew monthly
  • Cancel anytime - service continues through paid period
  • No refunds for partial months
  • You are responsible for all applicable taxes

6. Service Delivery and Limitations

Response Times

AI processing typically takes a few minutes. eMessage delivery times vary by facility and SECURUS procedures.

Message Limits

  • Maximum 20,000 characters per eMessage
  • Up to 5 images per eMessage
  • Long responses automatically split across multiple messages

Service Availability

While we strive for 99.9% uptime, we cannot guarantee uninterrupted service due to:

  • SECURUS system maintenance or outages
  • Facility lockdowns or restrictions
  • AI service provider limitations
  • Scheduled maintenance (with advance notice when possible)

7. Privacy and Data Security

Your privacy is important to us. Key points:

  • Service Representatives never read eMessages - they're processed by AI
  • Account holders cannot view incarcerated users' message content
  • All data encrypted in transit and at rest
  • Compliance with correctional facility monitoring requirements

8. Intellectual Property

KITEAI Property

The KITEAI service, software, and branding remain our exclusive property.

User Content

  • You retain ownership of your requests and personal content
  • AI-generated responses are provided for your use
  • We may use anonymized data to improve our services

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Accuracy or completeness of AI-generated content
  • Fitness for any particular purpose
  • Uninterrupted or error-free service
  • Compatibility with all correctional facilities

10. Limitation of Liability

KITEAI SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, or consequential damages
  • Loss of data or service interruptions
  • Actions taken based on AI-generated content
  • SECURUS system issues or facility restrictions

Our total liability shall not exceed the amount paid for the service in the preceding month.

11. Termination

By You

You may cancel your subscription at any time through your account dashboard.

By KITEAI

We may suspend or terminate service for:

  • Violation of these terms or acceptable use policy
  • Non-payment of subscription fees
  • Requests that consistently violate content policies
  • Any activity harmful to our service or other users

12. Modifications to Service and Terms

We reserve the right to:

  • Modify or discontinue features with reasonable notice
  • Update these terms as needed
  • Change pricing with 30 days advance notice

Continued use after changes constitutes acceptance of modified terms.

13. Governing Law and Disputes

These terms are governed by the laws of the State of California. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
